At the Parish Council meeting held on Monday evening, Borough Councillor Harry Tonge provided an update on discussions that have been taking place with Highways Parking Enforcement with regards to the parking 'fines' issued recently to owners of a number of vehicles parked on the Bye Pass Road footpath.
The law states that vehicles obstructing shared cycleway footpath are causing an obstruction. This is an offence and owners are liable to receive a parking enforcement notice.
However, it transpired during discussions that the authority covering enforcement on the A54 through Tarvin is Cheshire Police and not Cheshire West and Chester Council. As a result, the enforcement notices were not validly served. In view of this, those in receipt of a parking enforcement notice relating to Bye Pass Road may contact Councillor Tonge and provide him with the enforcement notice number and he will arrange to have this cancelled.
It should be noted however, that parking offences pursued by the police could attract heavier financial penalties than those levied by the council and could also include endorsing licenses with penalty points.
